Hongkong VISA related- SGL

Summary

现在的 target 是 1 月 7 号直接签工作，主要的问题是 1 月 6 号才答辩完，没办法拿到学校的 graduate certificate。同时，我现在的 student visa 是到 30-04-2025。

现在可选的关于 visa 的三种方案：

1. 直接使用 IANG 签证： 参考下面 #IANG 相关 的 Q12 和 Q13，是没办法操作的
2. 在拥有 student visa 的情况下，同时直接参与工作，参考下面#Student Visa的Q20：需要学校提供 NOL（No Objection Letter） 证明，需要找学校，比较麻烦
3. 直接申请永居，参考下面的#永居相关：主要的问题是我目前 visa 在 pandemic 期间断掉了两年，就需要提供 argument letter，现在是想通过 HKCLR（香港物流中心），刘教授的说明函去 argue 一下。流程最快 25 天，且有很大的不确定性

Q12: Can a recent graduate submit application under the IANG before the issuance of the graduation certificate?

Non-local recent graduates / GBA campus recent graduates who have not yet obtained their graduation certificate could apply to stay/come and work by producing a proof from the institution confirming that he/she has graduated (proof of graduation).

Q13: Can a recent graduate submit application under the IANG before the receipt of proof of graduation?

Applications under the IANG cannot be processed without proof of graduation. Non-local recent graduates / GBA campus recent graduates should submit applications after the receipt of proof of graduation.

Q20：
Besides, with effect from 1 November 2024, non-local students (excluding exchange students) of full-time locally-accredited local programmes at undergraduate level or above whose study period is not less than one academic year are temporarily exempted from the above employment restrictions that they may take up employment in Hong Kong during the currency of their limit of stay or within the effective period as specified in the “No Objection Letter” (NOL) issued to them (if applicable), whichever is the shorter.

个人签证时间计算：

• 第一次签证 48 个月：05-04-2017 ，expire day 是 01-02-2021
• 第二次签证 7 个月： 01-02-2023 到 01-04-2023 最后 expire day， 16-08-2023
• 第三次签证直接给到 2023 年底： 07-12-2023 到 31-12-2023
• 第四次签证到 2025 年： 27-09-2024 到 30-04-2025，首次入境时间 22-11-2024

总时间为： 17，18，19，20 四年 + 23 年整年 + 24 年下半年 = 5 年半

没有续签的原因：21，22 年是因为 pandemic 而且我是湖北的籍贯 香港入境政策特别限制湖北人入境隔离的时间更长，24 年上半年是因为都在香港中文大学福田研究院。

香港永居申请流程

• 整个申请流程最快 25 天，我问过这边一个师姐，她是五月申请的。

连续在港 7 年的条件，可申请永居，流程与步骤如下：
申请资料包括：

1. 填写申请表格：ROP145-《申请核实永久性居民身份证资格(其他申请人适用)》；
2. 香港身份证（如有）和过去 7 年的入境许可标签复印件及目前在港逗留条件的旅行证件；
3. 在香港通常居住连续七年的证明文件（学校文件、就业证明、银行结单等）。可提供学校文件

后续流程：
完成信息填写之后保存确认书，然后等入境事务处发信：

• 第一封信：确认收到申请，正常情况下，如果证明文件齐全，入境事务处需要六星期处理申请，发出第一封信。但根据以往经验，一般在 10 天左右就会收到。
• 第二封信：补交文件（若需要）
• 第三封信：预约见主任，见完主任核实完相关信息后可以去办理香港身份证，旧的身份证会被回收，接下来可以申请香港护照，证件办好后，可以去领取永居身份证 + 香港护照。

1. 我是否需要连续在香港居住七年，才可获得永久性居民身分？
但在香港住满七年之规定，并不等于一定要在香港逗留整整七年而不能出境，法律只规定，有关人士在该段期间内必须是 「通常居于香港」 。尽管有关人士在七年内曾因事而暂时离开香港，但仍可能被继续视为通常居于香港。「暂时性」一词并无清楚确实的定义，但《入境条例》第2(6)条列明若干可供考虑的因素，以便决定有关人士是否不再通常居于香港。

如香港是阁下的居住地方，但阁下因事而暂时离开香港，在这情况下，仍会被视为继续居留于香港。换言之，若阁下曾往外地度假、公干或短期留学，在香港的居留时期不会因而被中断。尽管期间阁下曾暂时离开香港，仍可累积七年的居留期。
